General Terms and Conditions

 

1 Scope of application

 

These General Terms and Conditions (GTC) also serve as conditions of participation and govern the relationship between Blue Bug Tours (hereinafter "Organiser") and its customers (hereinafter "Participants") who participate in Blue Bug Tours road trips (hereinafter also "Excursions") and use vehicles arranged for hire by Blue Bug Tours. By booking and participating in Blue Bug Tour road trips, the participants accept these GTC. These GTC and conditions of participation apply to all agreed bookings and contracts and do not allow for any ancillary provisions drafted by the participant. 

 

2 Participation fees, bookings and payment

 

2.1 The booking of a road trip / an excursion with Blue Bug Tours can only be made online via our email or by post via our company address. The booking is binding with the booking email or booking letter and is considered confirmed after confirmation email by the organiser.

 

2.2 The participation fee is due 14 calendar days after receipt of the confirmation email from Blue Bug Tours and must be transferred to the account of Blue Bug Tours by bank transfer. Blue Bug Tours reserves the right to cancel the reservation / booking if the deadline is not met. The organiser also reserves the right to change the prices at any time. However, bookings already made will be charged at the participation fees valid at the time of booking.

 

2.3 The participation fee includes the legally applicable value added tax. 

 

2.4 The participation fee includes the following services with regard to the Cono Sur 2024 trip:

  • Overnight stays in a double room incl. breakfast from 5 October 2024 to 17 October 2024 or from 3 November 2024 to 15 November 2024 in ***/**** hotels, depending on regional availability.

 

  • The vehicle (VW Beetle, 70s, 80s, 90s, 2-seater, CB radio) incl. fuel costs and local motor vehicle liability insurance. 

 

  • Organisation of the trip, documentation, group communication, escort vehicles and German-speaking tour group leader and local guides/mechanics.

 

2.5 All costs not listed under 2.4, such as catering, any tolls, ferries or special trips, shall be borne by the participant. Attention is drawn to the special and customary national requirements (health insurance cover, vaccination cover, travel cancellation cover, travel costs, VISA costs if applicable, etc.).

 

2.6 Special events are offered for some stations (e.g. Buenos Aires, Mendoza and Santiago). These are not included in the participation fees and may be adjusted and / or cancelled by the organiser at short notice.

 

3 Performance of services, deviations, cancellation and changes to bookings

 

3.1 Blue Bug Tours offers participation in organised excursions with a limited number of participants on tours that have been prepared in advance and defined over the specified period. Participants will take part in these tours under the supervision of the organiser and will be subject to the group tour. The rides are neither a racing event nor a rally. Participants are responsible for complying with local road traffic regulations. Regardless of any group action, the actions and behaviour of each participant remain their own responsibility. The participant must always ensure his/her own safety, the safety of the group participants and the safety of other third parties. The organiser reserves the right to decide on immediate exclusion from the group in the event of non-compliance. The participant therefore loses any right to further participation, reimbursement of costs or cost compensation for the onward journey / return journey etc. to be borne at their own expense.  

 

3.2 Blue Bug Tours organises the excursions to the best of its knowledge and belief. As the organiser of an excursion with an adventure character, Blue Bug Tours assumes no liability for planned or spontaneous deviations from the previously published tour planning. In particular, Blue Bug Tours will endeavour to provide the best possible remedy in the event of road closures, traffic-related deviations or breakdowns and any resulting changes to the timetable or tour schedule. However, there is no liability obligation towards the participant with regard to the brochure presentation and explanation. Such incidents are an unavoidable and expected part of the joint excursions.

 

3.3 Cancellations and changes to bookings must be notified in writing by email or post. Cancellations are subject to the following conditions:

  • Cancellation more than 3 calendar months before the planned date of travel: 

Refund of the participation fee minus an administration fee of 25%.

 

  • Cancellation 3 calendar months to 1.5 calendar months before the planned date of travel: 

Refund of the participation fee less an administration fee of 50%.

 

  • Cancellation less than 1.5 calendar months before the planned travel date: 

No refund possible.

 

3.4 Changes to bookings (e.g. change of travel date) are only possible after consultation with the organiser and are subject to availability.

 

3.5 Blue Bug Tours reserves the right to cancel or change the dates of an excursion up to 7 calendar months before the date of travel. Any resulting costs incurred by the participant will be borne by the participant. In the event of cancellations or date changes less than 7 calendar months before the start of the tour, Blue Bug Tours will contact the participants personally and contribute to finding an amicable solution by providing proof of the costs incurred by the participant. 

 

4 Exclusion of liability

 

4.1 The organiser assumes no liability for injuries, damages, losses, accidents or the like that occur during the road trip / excursion, unless they are due to gross negligence or intent on the part of the organisation.

 

4.2 Participants are responsible for complying with all traffic regulations and laws during the road trip/excursion. The organiser accepts no liability for violations of applicable laws by participants.

 

4.3 The organizer is not liable for any loss or damage to the participants’ personal property.

 

4.4 The vehicle hire company assumes repair and maintenance costs to the usual and expected extent. Damage repairs that are clearly attributable to the participant's driving style will be charged to the participant at the organiser's cost price or on presentation of proof. 

 

5 Insurance

 

5.1 Participants are obliged to take out suitable travel and health insurance for the road trip/excursion. Damage in terms of liability insurance is covered by the vehicle hire company's insurance. 

 

6 Vehicle utilization

 

6.1 Participants are obliged to treat the vehicles provided with care and to comply with all applicable traffic regulations and laws.

 

6.2 Any damage or loss to the vehicles caused by negligence or improper use during the road trip/excursion shall be borne by the participant responsible.

 

6.3 Private use of the vehicle for journeys outside the travel times (daily from approx. 06:00 to approx. 19:00) is only possible with the written permission of the organiser. A logbook must be kept for these journeys. The travelling radius is limited to a maximum of 30 km from the overnight accommodation. The fuel costs incurred for this are to be borne by the participant at a flat rate of € 30.00 per day.

 

7. changes to the road trip/excursion

The organiser reserves the right to change the road trip/excursion for reasons of force majeure or unforeseen circumstances. In this case, the organiser will do its best to offer alternative solutions or refund any fees already paid.

 

8. data protection

The Organiser's data protection guidelines are based on the General Data Protection Regulation.

 

9. use of image and sound recordings of the rides and evening events by the organizer

 

9.1 Declaration of consent to the use of image and sound recordings: The participant expressly agrees that the organiser may make image and sound recordings of the participants during the rides and the associated breaks and evening events. The participant grants the organiser the unrestricted right to use the image and sound recordings made for advertising purposes, including but not limited to use in print media, on websites, in social media, on posters, in brochures and in other advertising materials. The same applies to image and sound recordings of other participants. 

 

9.2 Intended use: The image and sound recordings made may be used for the following purposes, but are not limited to these:

  •  Advertising and promotion of the Organiser and its services.

 

  •  Public communications, including press releases and publications in the media.

 

  •  Participation in competitions or events.

 

  •  Other purposes related to the promotion and advertising of the Organiser's activities.

 

9.3 Waiver of remuneration and claims: The participant waives any remuneration, compensation or licence fees for the use of the image and sound recordings by the organiser. The participant waives any claims that may arise from the use of the image and sound recordings by the organiser, including claims to personal rights, data protection or copyrights.

 

9.4 Transfer of rights and duration: The participant agrees that the rights to the image and sound recordings are transferred to the organiser and that this transfer is permanent and irrevocable.

 

9.5 Revocation of the declaration of consent: The participant has the right to revoke his/her declaration of consent to the use of image and sound recordings in writing to the organiser at any time. In this case, future recordings of the participant will no longer be used for advertising purposes, but recordings already made will remain unaffected.

 

10 Place of jurisdiction and applicable law

 

10.1 These GTC are subject to German law.

 

10.2 The place of jurisdiction for all disputes in connection with these GTC and the road trips/excursions is the registered office of the Organiser. By booking and participating in the Organiser's road trips/excursions, participants declare their agreement with these General Terms and Conditions. The Organiser reserves the right to amend these General Terms and Conditions at any time.

 

11 Final provisions

 

11.1 These GTC shall enter into force upon the Participant's booking/reservation request and shall apply for an unlimited period.
